TERMS OF SERVICE

By downloading, installing, or using FlipFocus ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

FlipFocus is an offline-first flashcard application designed to help users study and learn through spaced repetition algorithms. The App includes features such as:

• Creating and managing flashcard decks (stored locally)
• Spaced repetition learning system (processed on-device)
• Progress tracking and analytics (stored locally)
• Game modes for interactive learning
• Media support (images, audio, text-to-speech)
• Local backup and restore functionality
• Optional Google account integration for backup ownership

No Account Required:

• FlipFocus works completely offline without any account
• All features are available without registration
• Optional Google account connection only for backup ownership identification

User Content Ownership:

• You retain complete ownership of all content you create (flashcards, media, etc.)
• Your content stays on your device - we never access or store it on our servers
• You are responsible for ensuring your content doesn't violate any laws or rights
• You can export your data anytime using the backup feature

Your Rights:

• You own all flashcard content you create
• You can export and use your data outside the App
• You retain rights to any media you upload

Our Rights:

• FlipFocus name, logo, and App design are our property
• We own the software, algorithms, and App functionality
• Pre-installed content and templates are our property

Premium Services:

• Advanced game modes and study features
• Enhanced TTS (Text-to-Speech) functionality
• Advanced analytics and insights
• Ad-free experience
• Additional customization options

Billing and Cancellation:

• Purchases and subscriptions are processed through your app store account
• Subscriptions may automatically renew unless canceled through your app store settings before the renewal date
• Refunds are handled according to the app store's policies
• Premium features remain available until the end of the current billing period

Advertising:

If the App displays ads, ad providers may process data to deliver ads, measure performance, and manage advertising functions, subject to their policies and your device settings.

• Your privacy is governed by our Privacy Policy
• All data stays on your device - we implement local security measures
• You control all your data - no external sharing or storage
• No data deletion requests needed - simply uninstall the app or reset in settings

• You are solely responsible for your use of the App, the content you create, import, share, or rely on, and any actions you take based on the App's outputs or features
• You use the App at your own risk
• To the maximum extent permitted by law, we are not responsible for any decisions, actions, or results arising from your use or misuse of the App

• FlipFocus is a study tool and does not guarantee learning outcomes, grades, exam results, or academic performance
• To the maximum extent permitted by law, the App is provided "as is" and "as available"
• We do not guarantee that the App will always be uninterrupted, secure, or error-free

• To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or opportunities arising from or related to your use of the App
• To the maximum extent permitted by law, we are not responsible for issues caused by your device, operating system, network, third-party services, or third-party content
• Non-Waivable Rights: Nothing in these Terms excludes or limits liability where doing so would be unlawful, or limits any consumer rights that cannot be excluded or waived under applicable law

By You:

• You may stop using the App at any time
• Because your study data is stored locally, you can delete it through the App settings (if available) or by uninstalling the App

By Us:

• We may modify, suspend, or discontinue the App or specific features at any time for technical, legal, or business reasons
• When reasonably practical, we will provide notice through the App or via app store updates

Informal Resolution First:

If you have a dispute, contact us first at nekocode.dev@gmail.com and we will try in good faith to resolve it.

Governing Law:

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict of law principles.

Consumer Rights:

Nothing in these Terms limits any rights you may have under applicable consumer protection laws that cannot be excluded or waived.

We may update these Terms periodically. We will:

• Notify users of significant changes through the App
• Post updated Terms with a new "Last Updated" date
• Continue previous Terms for existing users for 30 days

FlipFocus is designed to store your flashcards and study progress locally on your device. However, some optional features may rely on third-party services:

• App store billing for purchases and subscriptions (Google Play or App Store)
• Advertising services (if enabled) - ad providers may process data to deliver ads, measure performance, and manage advertising functions
• Text-to-speech engines (often provided by your device OS)
• Translation features (if enabled)
• OCR or text recognition features (if enabled)
• Optional Google sign-in or Google services (if enabled)
• Sharing/export/import features that interact with your device OS and other apps
• Local network features (if enabled)

When you use these features, relevant data may be processed or transmitted by the third-party or device service under that provider's own terms and privacy policies. We do not control and are not responsible for third-party services.

No Sale of Study Content:

We do not sell your flashcard content. If you choose features that send text or files to a third party (for example, translation or cloud storage), that content is processed by the third party to provide the feature you requested.
